Terms of Service

These Curator Terms of Service ("Curator Terms") govern your use of MusicPlayground's third-party ticketing platform and services for event organizers. By registering as a Curator, you agree to these terms in addition to our general Terms of Service and Privacy Policy.
1. Definitions
"Platform" refers to the MusicPlayground website, ticketing system, and related services.
"Organizer" or "You" refers to any individual or entity registered to sell tickets through our Platform.
"Event" refers to any concert, performance, gathering, or activity for which you sell tickets through the Platform.
"Ticket Buyer" or "Attendee" refers to individuals who purchase tickets to your Events.
"Commission Fee" refers to the per-ticket fee charged by MusicPlayground for use of the Platform.
2. Organizer Registration & Approval
2.1 Eligibility
To register as an Organizer, you must:
- Be at least 18 years of age
- Have the legal authority to organize and host events
- Provide accurate and complete registration information
- Have a valid bank account or payment method for receiving payouts
2.2 Approval Process
All Organizer registrations and event submissions are subject to review and approval by MusicPlayground. We reserve the right to reject any application or event that does not align with our community values, including but not limited to events that:
- Promote hate, discrimination, or violence
- Violate local laws or regulations
- Contain misleading or fraudulent information
- Do not meet our quality or safety standards
3. Commission & Fees
Commission Structure: MusicPlayground charges a flat per-ticket commission fee on each ticket sold. This fee is added to the ticket price displayed to buyers and is collected at the time of sale. The current commission rate is displayed in your Curator Portal and on the Curators page.
3.1 Fee Application
- The commission fee is added on top of your set ticket price
- Buyers see the total price (your price + commission) at checkout
- You receive 100% of your set ticket price, minus payment processing fees
- Free tickets (price set to €0) do not incur a commission fee
3.2 Fee Changes
MusicPlayground reserves the right to modify the commission rate. Any changes will:
- Be communicated to Organizers via the Platform and/or email
- Apply to events submitted after the change takes effect
- Not affect tickets already sold for approved events
4. Event Submission & Management
4.1 Event Information
You agree to provide accurate, complete, and current information for all Events, including:
- Event name, date, time, and venue
- Accurate description and lineup information
- Correct pricing for all ticket tiers
- Any age restrictions or entry requirements
- Venue capacity and ticket limits
4.2 Event Changes
Once an event is approved and tickets are on sale:
- Minor changes (description, images) may be updated directly
- Material changes (date, venue, price) require approval via Edit Request
- You must notify ticket buyers of any significant changes
- Repeated material changes may result in event removal
4.3 Event Cancellation
If you cancel an event:
- You must notify MusicPlayground immediately
- Full refunds will be issued to all ticket buyers
- Commission fees already collected will not be refunded
- Repeated cancellations may affect your Organizer standing
5. Payments & Payouts
5.1 Payment Collection
MusicPlayground collects payment from ticket buyers on your behalf. All payments are processed securely through VivaWallet.
5.2 Payout Schedule
- Payouts are processed within 24-48 hours after your event concludes
- Funds are transferred to your registered payout method (bank transfer or Revolut)
- You are responsible for any fees charged by your bank or payment provider
5.3 Payout Holds
MusicPlayground may withhold payouts in cases of:
- Suspected fraud or Terms violation
- Unresolved disputes or chargebacks
- Incomplete or inaccurate payout information
- Pending investigation into event issues
6. Refunds & Disputes
6.1 Refund Policy
Your events are subject to the following default refund policy:
- Tickets are generally non-refundable unless the event is cancelled
- Ticket transfers may be allowed at your discretion
- In case of event cancellation, full refunds will be issued
6.2 Dispute Resolution
In the event of a dispute with a ticket buyer:
- You agree to work with MusicPlayground to resolve the issue
- You are responsible for refunds arising from your event issues
- MusicPlayground's decision on disputes is final
7. Content & Intellectual Property
7.1 Your Content
You retain ownership of content you submit (event descriptions, images, logos). By submitting content, you grant MusicPlayground a non-exclusive license to use, display, and promote your events on the Platform and marketing materials.
7.2 Third-Party Content
You are responsible for ensuring you have the rights to use any third-party content (images, music, artist names) in your event listings.
8. Liability & Indemnification
8.1 Event Responsibility
You are solely responsible for:
- The planning, organization, and execution of your events
- Compliance with all applicable laws, permits, and regulations
- Health and safety of attendees at your events
- Accuracy of all event information provided
- Any claims arising from your events
8.2 Indemnification
You agree to indemnify and hold harmless MusicPlayground, its officers, employees, and affiliates from any claims, damages, or expenses arising from your events or violation of these Terms.
8.3 Limitation of Liability
MusicPlayground is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform or attendance at events.
9. Termination
9.1 By You
You may close your Organizer account at any time. Outstanding payouts will be processed for completed events.
9.2 By MusicPlayground
We may suspend or terminate your Organizer access for:
- Violation of these Terms or our general Terms of Service
- Fraudulent or illegal activity
- Repeated complaints from ticket buyers
- Any conduct harmful to the Platform or community
10. General Provisions
10.1 Amendments
MusicPlayground may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
10.2 Governing Law
These Terms are governed by the laws of Malta. Any disputes shall be resolved in the courts of Malta.
